Written Answers. - Inheritance Tax.

Ceist:

433 Mr. Perry asked the Minister for Finance if his Department will grant a person (details supplied) in County Sligo a waiver or reduction in inheritance tax in view of their circumstances; and if he will make a statement on the matter. [16861/02]

I am informed by the Revenue Commissioners that on the facts as disclosed it is not clear to what liability to inheritance tax the Deputy is referring. The Revenue Commissioners advise that they have been in contact with the agent for the taxpayer who has indicated that, in view of the value of the estate, no liability to inheritance tax should arise.

I am also informed that probate tax was postponed in this case as the spouse of the disponer took a life interest in the estate of the disponer. Under the provisions of the Finance Act, 2001, the position is that any probate tax postponed in these circumstances is not payable if the spouse of the disponer died on or after 6 December 2000, which I understand is the position in this case.
