265 Mr. Ring asked the Minister for Agriculture and Food when a suckler cow premium 2001 appeal will be finalised for a person (details supplied) in County Mayo. [20521/02]

I understand that the person concerned has recently lodged an appeal concerning the 2001 suckler cow premium scheme with the agriculture appeals office. Appeals to that office require individual examination and are dealt with in the order in which they are received. The appeal is being examined and the person concerned will be notified of the outcome in due course.

266 Mr. Connaughton asked the Minister for Agriculture and Food the reason the 2001 extensification payment has not been awarded to a person (details supplied) in view of the fact that this person appears to be within the stocking rates; and if he will make a statement on the matter. [20581/02]

The person named participated in 2001 extensification premium under the simplified system. On participation he undertook to maintain a stocking density of less than 1.60 livestock units per hectare for each and every day of 2001. Under EU regulations, prior to payment, the Department is required to carry out CMMS based cross-checks to ensure that the chosen stocking densities were not breached. In this case cross-checks were carried out on 1 June and 15 October 2001. Stocking densities of 1.7612 and 1.8294 livestock units per hectare were found on 1 June and 15 October 2001 respectively.

Under the terms of the relevant EU regulation, herdowners participating in extensification premium under the simplified system cannot be considered for payment where their chosen stocking density was found to have been breached. Since the stocking densities as set out above were found, the person named cannot be considered for payment of 2001 extensification premium.
