629 Dr. Upton asked the Minister for Justice, Equality and Law Reform if he will provide an update on his review of the Explosives Act, 1875, as it applies to fireworks; the additional steps which can be taken to control the use of fireworks in view of the great distress they cause to many people and animals; and if he will make a statement on the matter. [20154/02]

The review of the Explosives Act, 1875, as it applies to fireworks, is still ongoing. The Garda authorities have powers of arrest, search, seizure and destruction of seized fireworks under the provisions of the Explosives Act, 1875 and the Explosive Substances Act, 1883. I have been assured by the Garda authorities that they are constantly vigilant in the enforcement of these provisions. In addition, they liaise with local authorities and arrange media publicity regarding the dangers of handling fireworks.
