Ceist:

141 Mr. R. Bruton asked the Tánaiste and Minister for Enterprise, Trade and Employment the value of awards under labour legislation that have been made in 2001 for which data is available, distinguishing the element of the award that represents loss of earnings and the element that represents compensation for a wrong done. [19793/02]

There are three bodies under the aegis of my Department which have responsibility for making awards under labour legislation, the Employment Appeals Tribunal, the Rights Commissioner Service of the Labour Relations Commission and the Labour Court.

The only awards determined by the Employment Appeals Tribunal for which statistics are available are those made under the Unfair Dismissals (Amendment) Act, 1993. In 2001 these amounted to a total of €862,000. It is not possible to provide the breakdown sought by the Deputy as these awards are not broken down into elements for loss of earnings and elements for compensation for wrongs done.

Some €326,717.39 was awarded by the Rights Commissioner Service of the Labour Relations Commission during 2001. It is not possible to provide a breakdown along the lines sought by the Deputy as Rights Commissioners awards are not broken down into elements for loss of earnings and elements for compensation for wrongs done.
The Labour Court has an appellate role in relation to Rights Commissioners recommendations. In such cases, the court may affirm the recommendation of the Rights Commissioner, or overturn it, or vary it. The extent to which appeal decisions of the Labour Court affect awards made by Rights Commissioners in 2001 is set out below. The total figure indicates the amount by which the court increased awards by Rights Commissioners.
