71 Mr. Naughten asked the Minister for Agriculture and Food if there is a hardship fund for farmers who have to destroy their herd due to BSE; the levels of compensation involved; and if he will make a statement on the matter. [21953/02]

BSE legislation provides that farmers are compensated at current market value rates for animals that have been depopulated as a result of BSE. The compensation is paid to enable farmers to restock. Re-population of the farm is normally permitted 30 days after satisfactory completion of cleansing and disinfection so the farmer need not be out of business for a prolonged period. There is no legal provision for payment of other compensation in respect of BSE depopulations.

72 Mr. Naughten asked the Minister for Agriculture and Food when a person (details supplied) in County Westmeath will receive compensation for destocking; and if he will make a statement on the matter. [21954/02]

The herd to which the Deputy refers has been valued and the herdowner has indicated his acceptance of the offer. Arrangements are being made for the removal and slaughter of the herd. Once depopulation of the herd is complete and the necessary documentation received payment will issue to the person concerned.
