Ceist:

139 Mr. Kenny asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has received correspondence from a person (details supplied) in County Mayo, in respect of a company in respect of which serious allegations have been made; if she has arranged for an investigation to be carried out on the claims involved; if not, if she will make immediate arrangements to do so and issue a full report; and if she will make a statement on the matter. I confirm that I have received correspondence from the person in question and I am replying to the effect that it would not be appropriate for me or my Department to become involved in the internal affairs of a company. Therefore, I cannot assist in seeking the return of funds allegedly owed to the company, the subject of that correspondence.

I am advising the correspondent that if he has reason to believe that the provisions of the Companies Acts have been breached, he should bring this to the attention of the Director of Corporate Enforcement, 16 Parnell Square, Dublin 2, who now has statutory responsibility for the investigation of breaches of the Companies Acts. Furthermore, if there is reason to believe that fraud has been perpetrated, the matter should be brought to the attention of the Garda Bureau of Fraud Investigation, Harcourt Street, Dublin.
