149 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive an area based payment for 2002. [22175/02]

The person named applied for 17.76 hectares of forage land on his 2002 area aid application. However, the area found was only 14.76 hectares, a land parcel of 3.00 hectares was found to be a beach. This does not qualify as forage land and cannot be claimed as such. This resulted in an over-claim of 3.00 hectares or 20.33%. Under the EU regulations, no penalty is applied when the over-claim is less that 3%, the penalty is based on double the difference when the over-claim is between 3% and 20% and when the over-claim is greater than 20%, a 100% penalty must be applied. Therefore in this instance, a 100% penalty applies and no area based payment can issue to the applicant.

150 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive an extensification payment for 2001; and when this person will receive the CMMS based herd profiles as promised in a previous reply. [22176/02]

Due to unforeseen difficulties it was not possible to supply a CMMS based herd profile to the person named and to some others who were not paid extensification premium because the stocking density at 1 June and 15 October 2001, according to the CMMS database, exceeded their chosen limits. These difficulties have now been overcome and a herd profile issued to the person named on 14 November 2002. On the basis of the information on the profile, the person named does not qualify for 2001 extensification premium. If, however, he can show that the information on the profile is incorrect, the matter will be considered further.

151 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive an area based payment for 2002. [22177/02]

The 2002 area aid application of the person named has been fully processed with an area determined for payment purposes of 113.08 hectares. The person named will be paid his full entitlement under the 2002 area-based compensatory allowance scheme shortly.

152 Mr. Ring asked the Minister for Agriculture and Food when area based payments for 2002 will issue to a person (details supplied) in County Mayo. [22179/02]

The person named included a parcel of land on his 2002 area aid application which overlapped with a land parcel belonging to another herdowner. Both parties have been written to in order to clarify the matter and replies are awaited. Until this matter is resolved the area aid application of the person named cannot be fully processed and no area related payments can issue to him.

153 Mr. Kehoe asked the Minister for Agriculture and Food the reason for reduced REP scheme payments made to a person (details supplied) in County Wexford; and if he will make a statement on the matter. [22211/02]

The person named commenced in REPS on 1 December 1997. The contracted area in his plan was 24.89 hectares, 2.69 hectares of which was target area land. Under the scheme conditions then in force, payment at the enhanced rate for target area land was made on the full contracted area of 24.89 hectares. An amended agri-environmental plan was received from the person named in July 1999. In the meantime the scheme conditions had changed and the amended plan was subject to the new conditions. These conditions provided that only the target area land would be paid at the enhanced rate. The person named has, therefore, been paid the correct rates.
