Michael Ring

Ceist:

193 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive area based payment for 2002. [3927/03]

The probate submitted does not cover all the lands in the estate. My Department will contact the solicitor involved and when outstanding issues have been resolved payment will issue to the person named.

Ned O'Keeffe

194 Mr. N. O'Keeffe asked the Minister for Agriculture and Food the reason the incorrect rate of payment in respect of the slaughter premium top up 2002 was issued to a person (details supplied); if his attention has been drawn to the fact that throughout the years incorrect payments have issued to this person; and if he will investigate the payment of £50 owed to this person since 1995 under the special beef premium scheme. The person named has received slaughter premium and national envelope top-up on a total of eight and two animals respectively under the 2002 slaughter premium scheme. Slaughter premium advance payment totalling €512 and national envelope top-up advance payment of €36.56 issued at the correct rate in respect of all eligible animals. The balancing payments are due to issue in April 2003. The person named submitted one application in respect of ten animals for the 22-month tranche of premium under the 1995 special beef premium scheme. Following an on-farm inspection it was discovered that six of the animals were ineligible on age grounds. The person named was found to have made a false declaration due to serious negligence and was thus excluded from the special beef premium scheme for the calendar year 1995. The moneys paid to the person named were subsequently recouped from moneys due to him under 1997 and 1998 premia schemes. Thus there are no outstanding payments due to the person named in respect of the special beef premium scheme.

Ned O'Keeffe

195 Mr. N. O'Keeffe asked the Minister for Agriculture and Food if an application under the 2001 extensification premium scheme, where a person (details supplied) in County Cork has confirmed that a number of their animals were deceased and were included for calculating livestock units, will be re-examined; if this person's livestock units will be recalculated; and the reason this farm was not inspected. [3937/03]

The person named participated in the 2001 extensification premium opting for the census system. Based on his own declarations, the person named had a stocking density of 1.9941 livestock units per hectare. This would qualify him for payment of extensification premium at the low rate of payment. Prior to payment the Department is required to carry out stocking density cross-checks against the CMMS database to ensure that the true stocking densities of holdings are within payment guidelines. Initially, the outcome of this cross-check revealed a discrepancy involving some five animals that had the effect of bringing the stocking density of the holding to outside of payment limits. The discrepancy has since been resolved and a payable order for €1,485.00 due to the person named issued to him on 20 January 2003. On the same date a payable order for €14.85 due in euro compensation also issued. The sums paid represent payment on the 45 male animals on which 2001 special beef premium had already been paid.
