255 Mr. McGuinness asked the Minister for Finance the grade or grades of public service employees which are entitled to allowances outlined in Circular 11/82; if those employed by Dúchas in receipt of industrial wages qualify; and if he will make a statement on the matter. [4344/03]

Circular 11/82 outlines the regulations that govern the payment of travel and subsistence allowances to non-industrial staff in the Civil Service. The actual rates of allowances payable from time to time are determined in accordance with agreed recommendations made by the general council under the scheme for conciliation and arbitration for the Civil Service. While not directly applicable to public servants outside the Civil Service, the provisions of Circular 11/82 underpin the determination of entitlements of travel and subsistence payments for many non-industrial staff throughout the public service.

Most industrial civil servants, including those employed by Dúchas, are covered by the travel and subsistence provisions applicable to State industrial employees, which differ in a number of respects from those, which apply to general Civil Service grades referred to above. Amendments to the provisions or changes in rates of payment for industrial staff would be a matter for discussions under the auspices of the Joint Industrial Council for State Employees.
