367 Mr. McGuinness asked the Minister for Health and Children the reason the file of a person (details supplied) in County Kilkenny has not been released in full under the Freedom of Information Act, 1997; and if he will request the SEHB to give full details to this person. [4536/03]

Where an applicant is dissatisfied with a decision made by a public body under the Freedom of Information Act, the Act provides for the right of review of that decision to the public body concerned. The public body must have the request reviewed by someone more senior than the person who made the original decision. The reviewer may affirm, vary or annul the original decision and if appropriate, make an alternative decision. The Act also provides for a further review mechanism to the Information Commissioner.

As the South-Eastern Health Board is the public body concerned in this case, my Department has no function in this process.
