Written Answers - Milk Quota.

97 Mr. McGuinness asked the Minister for Agriculture and Food if a 20,000 gallon milk quota will be granted to a person (details supplied) in County Kilkenny; and if he will make a statement on the matter. [6016/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. The person named submitted an application, but the conditions of the scheme were not satisfied and an allocation was not made. An appeals procedure exists in relation to this scheme and the person named has taken advantage of it. The assessment of appeals will be based on recommendations from the milk quota appeals tribunal. When the appeals process is completed each appellant will be notified of the outcome.

98 Mr. M. Moynihan asked the Minister for Agriculture and Food if a person who acquired milk quota under the 10,000 gallons scheme in 1992, purchased quota under various restructuring schemes and was allocated quota under the 32 million litres scheme recently, will be entitled to sell this quota with their land as a dairy enterprise, in view of the fact that this quota was all granted to them in compensation for being depopulated by his Department following a brucellosis outbreak. Milk quota transactions are governed by the European Communities (Milk Quota) Regulations 2000. Regulation 26(8) of those regulations stipulates that milk quota purchased under a restructuring scheme cannot be transferred by way of sale of land.

The other allocations referred to came from the national reserve and such allocations are granted for the producer's use only and may not be transferred by way of sale of land.
