Written Answers - Asylum Applications.

Ceist:

223 Mr. Hogan asked the Minister for Justice, Equality and Law Reform when a decision will be made in respect of a person (details supplied) in County Kilkenny who is seeking asylum; and if he will make a statement on the matter. [9406/03]

The person concerned arrived in the State on 11 April 2001 and applied for asylum. His claim for refugee status was refused by the Office of the Refugee Applications Commissioner on 18 October 2001 and he was notified of the decision on 21 November 2001. The applicant appealed the decision on 12 December 2001. The Refugee Appeals Tribunal affirmed the decision of the Office of the Refugee Applications Commissioner and the person concerned was notified of this decision on 28 February 2002.

In accordance with section 3 of the Immigration Act 1999, the person concerned was informed on 27 March 2002 that the Minister proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out the reasons why he should be allowed to remain temporarily in the State, leaving the State before the order was made or consenting to the making of a deportation order. Representations were received as to why the person concerned should be allowed remain in the State. I expect the case file in this matter to be submitted to me for a decision shortly.
