90 Mr. Broughan asked the Minister for Communications, Marine and Natural Resources the response his Department intends to issue to the ultimatum from the EU Commission to designate coastal bays and estuaries as suitable for shellfish production by 17 April 2003; if the deadline for the response will be met; and if he will make a statement on the matter. 245 Mr. Ferris asked the Minister for Communications, Marine and Natural Resources the response he intends to give to the EU Com mission regarding the failure to fulfil the directive on designating bays and estuaries suitable for shellfish production. [10621/03]

I propose to take Questions Nos. 90 and 245 together.

My Department recently received a complaint from the EU Commission alleging, inter alia, failure by Ireland to designate shellfish growing waters in accordance with obligations under EU Council Directive 79/923/EEC on the Quality of Shellfish Waters. A formal response to the Commission will be issued within the specified time frame in the light of legal advice from the Attorney General and consultation with the Department of the Environment and Local Government and relevant agencies.
