Ceist:

399 Mr. Gormley asked the Minister for Justice, Equality and Law Reform the position in regard to the application for political asylum from a person (details supplied) who has been told by their solicitor that their files have been lost by his Department. [12917/03]

The Refugee Applications Commissioner determined that the application for refugee status by the person referred to by the Deputy should properly be transferred to the United Kingdom in accordance with the Dublin Convention. That decision was affirmed by the Refugee Appeals Tribunal. Subsequently, my predecessor made a deportation order in respect of the person. The person referred to has sought leave of the High Court to apply for judicial review of the decisions in the case. In the circumstances, it would be inappropriate for me to make any further comment in relation to the case until the judicial review proceedings have been determined. I can confirm that the files for the person in question have not been lost and are currently located in the judicial review unit of the immigration division of my Department.
