Michael Noonan

163 Mr. Noonan asked the Minister for Agriculture and Food the reason for the delay in payment of the 2001 extensification premium to a person (details supplied) in County Limerick; and if payment will be made. [13379/03]

The person named applied for area aid in 2001 in respect of 41.53 hectares but this included a land parcel in respect of which an overclaim of 1.28 hectares or 3.18% was determined.

Under EU rules where an applicant makes an area overclaim of between 3% and 20%, a penalty of double the difference must be applied in determining the area eligible for payment purposes. After application of the penalty, an area of 37.69 hectares was determined for this herd owner's 2001 area aid and he did not qualify for 2001 extensification premium.

The person named requested a review of his 2001 application on the basis that the area over claimed was less than that recorded on the area aid system. Following an on-the-spot inspection, the area found has been revised upwards to 40.56 hectares which is sufficient for him to qualify for payment of 2001 extensification premium. Payment of €791.92 has now issued to the person named.

164 Mr. Ring asked the Minister for Agriculture and Food the reason a person (details supplied) in County Mayo did not receive an extensification payment for 2001 or area based payments for 2002. [13396/03]

The person named will be paid his full entitlement under the 2002 area-based compensatory allowance scheme shortly. The person named did not opt to participate in 2001 extensification premium. In any event, extensification premium is only payable on animals that have already qualified for payment in the same herd of 2001 suckler cow premium and-or 2001 special beef premium. He did not apply under either of these two schemes in 2001. Also, the person named did not opt to participate in 2002 extensification premium.

165 Mr. Neville asked the Minister for Agriculture and Food when sanction of a grant for control of farmyard pollution will be made to a person (details supplied) in County Limerick. [13397/03]

The person named was an applicant under the farm waste management scheme but his application was withdrawn on 29 October 2002. If a new application is received, it will be processed in the prescribed manner.
