162 Mr. Deenihan asked the Minister for Agriculture and Food the position regarding the appeal by a person (details supplied) in County Kerry against the decision not to grant them additional milk quota under the scheme for farmers who were in a farm modernisation scheme before 1984; and if he will make a statement on the matter. [17885/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. An application was submitted by the person named in relation to this quota. However, as the conditions of the scheme were not satisfied, an allocation was not made. An appeals procedure was put in place in relation to this scheme and almost 2,000 appeals were received and assessed. The outcomes of such appeals were notified to the appellants last week. There is no record of the person named having submitted an appeal.
