459 Mr. Haughey asked the Minister for Transport the reference number for regulations made to date in respect of penalty points; if he will make these regulations available; and if he will make a statement on the matter. [18529/03]

The Road Traffic Act 2002 (Commencement) Order 2002 (S.I. No. 491 of 2002) commences the relevant provisions in the Road Traffic Act which provide for the application of penalty points to speeding.

The Road Traffic Act 1961 (Section 103) (Offences) Regulations 2002 (S.I. No. 492 of 2002) provide for the application of fixed charges to speeding offences with effect from 31 October 2003.

The Road Traffic Act 1994 (section 25) (Commencement) Order 2002 (S.I. No. 597 of 2002) and the Road Traffic Act 2002 (Commencement) (No 2) Order 2002 (S.I. No. 598 of 2002) commences provisions requiring both full and provisional licence holders to carry their driving licence with them when driving with effect from 1 January 2003. This is a central component to the successful operation of the penalty points system.

The Road Traffic Act 2002 (Commencement) Order 2003 (S.I. No. 214 of 2003) commences provisions in the Act which provides for the application of penalty points to driving without insurance with effect from 1 June 2003.
All of the above regulations have been laid before the Houses of the Oireachtas and are available in the Oireachtas Library.
