Ceist:

471 Aengus Ó Snodaigh asked the Minister for Justice, Equality and Law Reform if he will stay the deportation of persons (details supplied) and allow them time to file an appeal; and if he will make a statement on the matter. [18262/03]

The family referred to by the Deputy claimed asylum in the State on the 19 August 1999. Their applications were refused following consideration by the Office of the Refugee Applications Commissioner at first instance and on appeal by the Office of the Refugee Appeals Tribunal. An application for temporary leave to remain was submitted by their legal representatives on 6 February 2002.

Following consideration of their case under section 3(6) of the Immigration Act 1999 I signed deportation orders in respect of the three family members on 22 April 2003. They presented themselves to the Garda National Immigration Bureau on 15 May 2003 as requested but owing to the subsequent hospitalisation of the wife, their removal has been delayed by the Garda National Immigration Bureau. The family is next to report to the Garda National Immigration Bureau on 9 July 2003.
Full consideration has been given to their case, including consideration of recent representations received. The family has exhausted the asylum and immigration processes and their removal from the State must take place as soon as the wife is fit to travel.
