Ceist:

241 Mr. F. McGrath asked the Tánaiste and Minister for Enterprise, Trade and Employment the position regarding the Companies (Audit and Accounting) Bill; if her attention has been drawn to the negative impact on voluntary and community organisations in relation to personal liability; and if she will make a statement on the matter. [19671/03]

The Companies (Auditing and Accounting) Bill 2003 was initiated in the Seanad on 14 February 2003, completed all Stages there on 29 May 2003 and will proceed to be introduced in the Dáil during the autumn session. I understand that the voluntary and community organisations which are set up as private companies limited by guarantee are particularly concerned about the application to them of the directors' compliance statement provided for in section 43 of the Bill. This is one of a number of concerns regarding the section I am examining and I will bear their concerns in mind during the course of this examination.
