John McGuinness

Ceist:

199 Mr. McGuinness asked the Minister for Agriculture and Food if grants due to a person (details supplied) in County Kilkenny will be awarded immediately. [21930/03]

The person named is an applicant under both the farm waste management and dairy hygiene schemes. Payment of €3,279.72 was made to the person under the farm waste management scheme on 29 September 2003. His application for a grant under the dairy hygiene scheme is currently being examined by my Department in order to determine its eligibility.

Michael Moynihan

Ceist:

200 Mr. M. Moynihan asked the Minister for Agriculture and Food when the 2003 area aid premium will issue for a person (details supplied) in County Cork. [21931/03]

The holding of the person named was selected for an on-the-spot inspection in accordance with normal control procedures. This process has now been completed and his area aid application has been fully processed with an area determined for payment purposes of 83.38 hectares. Payment of his full entitlement under the 2003 area-based compensatory allowance scheme on the maximum of 45 hectares will issue shortly.

Michael Moynihan

201 Mr. M. Moynihan asked the Minister for Agriculture and Food when the 2003 area aid premium will issue for a person (details supplied) in County Cork. [21932/03]

The holding of the person named was selected for an on-the-spot inspection in accordance with normal control procedures. This process has now been fully completed. The person named claimed a total area of 73 hectares but it was established that he was only entitled to claim 70.51 hectares. This resulted in an over-claim of 2.49 hectares or 3.53%. Under EU rules, where an applicant makes an area over-claim of between 3% and 20%, a penalty of double the difference must be applied in determining the area eligible for payment purposes. Therefore, after application of the penalty, an area of 65.53 hectares was determined for this herdowner's 2003 area aid. However, no penalty may arise if the named person remains within the limit of 1.8 livestock units per hectare in respect of animals applied for under the 2003 livestock premium schemes. Payment of his full entitlement under the 2003 area-based compensatory allowance scheme on the maximum of 45 hectares will issue shortly.

Ned O'Keeffe

202 Mr. N. O'Keeffe asked the Minister for Agriculture and Food the position regarding an appeal in relation to area aid by a person (details supplied) in County Cork. [21933/03]

The agriculture appeals office received this appeal on 11 September 2003. Appeals require individual examination and are dealt with in the order in which they are received. The appeals office will contact the appellant shortly to arrange the oral hearing that he requested. It is not expected that there will be any undue delay in dealing with this case.

Pat Breen

203 Mr. P. Breen asked the Minister for Agriculture and Food the reason a person (details supplied) in County Clare was not awarded suckler cow or beef premium in 2003; and if he will make a statement on the matter. [21956/03]

The person named has not submitted any applications to date under the 2003 special beef premium scheme. He is not an applicant under the 2003 suckler cow premium scheme, nor does he hold any suckler cow quota rights.

204 Mr. Deenihan asked the Minister for Agriculture and Food when an area-based payment will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [21957/03]

The 2003 area aid application of the person named has been fully processed with an area determined for payment purposes of 41.24 hectares. Payment of the full entitlement under the 2003 area-based compensatory allowance scheme will issue shortly.
