189 Aengus Ó Snodaigh asked the Minister for Justice, Equality and Law Reform the outcome of the Garda Commissioner's report into the case of a person (details supplied) in County Kerry requested by him in March 2003. [22774/03]

I have received a report from the Garda Commissioner in this matter and I have given careful consideration to it, having full regard to the communications received from and on behalf of the person concerned. In preparing their report, I am informed that the Garda Síochána conducted a re-examination of the papers and that no new evidence came to light.

I also note, as mentioned in my reply to a previous Parliamentary Question in this matter, that the Garda Síochána Complaints Board investigated a complaint made by the person concerned into the relevant issues and found that neither an offence nor a breach of discipline on the part of any member of the Garda Síochána had been disclosed.
