Ceist:

209 Mr. Ring asked the Minister for Social and Family Affairs if a reassessment can be arranged for a person (details supplied) in County Mayo in relation to the widow's non-contributory pension. [22746/03]

The person concerned was in receipt of widow's non-contributory pension at the reduced weekly rate of €75.55 until May 2000. Payment of pension was discontinued as she failed to substantiate the disposal of capital arising from the sale of her farm and dwelling. An appeals officer subsequently upheld the deciding officer's decision.

Her entitlement was reviewed in October 2002. She was advised by a local officer of the Department about the implications of not substantiating the disposal of a significant amount of capital. She did not produce supporting documentation and her application was again refused.

If she is now in a position to provide evidence of the alleged disposal of capital she should furnish relevant documentation. Her entitlement to pension will then be reconsidered.

Under social welfare legislation decisions in relation to claims are made by deciding officers and appeals officers. They are statutorily appointed and I have no role in regard to making such decisions.
