Aengus Ó Snodaigh

Ceist:

89 Aengus Ó Snodaigh asked the Minister for Defence the steps he has taken to satisfy his Department and the Revenue Commissioners that a company (details supplied) and its beneficial owners, the purchasers of Clancy Barracks in Dublin, are tax compliant in relation to Ireland and in relation to the state or states in which the persons involved are resident. 90 Aengus Ó Snodaigh asked the Minister for Defence if the purchase of Clancy Barracks has been completed; if so, the amount received for the property; the name and address of the company which is purchasing this property; the directors of the said company or trust; the activities in which this company has previously engaged in here or within the European Union; and if Government contracts have been awarded to this company or to another company owned by the beneficial owners or directors of the purchasing company. I propose to take Questions Nos. 89 and 90 together.

My Department has accepted an offer from Florence Properties Limited, for the sale of Clancy Barracks, Dublin. The legal formalities attendant on the sale have proven to be protracted and a contract of sale has not yet been signed. Pending the signing of the contract of sale it would not be appropriate to comment on details of the sale. An appropriate condition in relation to the production of a tax clearance certificate is, however, included in the proposed contract of sale.

Florence Properties Limited, issued a press release in November 2002 indicating that it had agreed to purchase the property in question. The press release stated, inter alia, that:

Florence Properties (Ireland) is a wholly owned subsidiary of Florence Properties (Jersey) which is owned by a trust company, the beneficiaries of which are the family of Irish – born property developer David Kennedy. The directors of Florence Properties (Ireland) are Mr. David Kennedy Jnr. and Mr. Pat Gleeson.

There is no record of any contract having been awarded to Florence Properties Limited by my Department.

91 Mr. Boyle asked the Minister for Defence the commitments which have been given to Ballincollig soccer club in relation to the use of allocated community land at the former Murphy's Barracks, Ballincollig, County Cork; if these commitments have changed; if so, the reason therefor; and if not, if he will confirm in writing the commitment he has given to them on the land they can use and the purposes for which it can be used. In the context of the disposal of Murphy Barracks, Ballincollig, I agreed to the handover of approximately 27 acres to Cork County Council. This area includes land which is to be made available for the provision of football playing pitches.

I recently met representatives from Ballincollig AFC in relation to the location of the soccer pitches. Having reconsidered the matter I am agreeable to the original allocation of areas of land, both north and south of the mill race, to the club on the basis agreed at my meeting with representatives of the club at the County Hall, Cork, on 18 January 2002. I will be in communication with the club in this regard.
