171 Mr. Cuffe asked the Minister for Communications, Marine and Natural Resources his plans to review the membership of the boards of the Marine Institute and Bord Iascaigh Mhara following the questions raised on a recent television programme (details supplied) regarding certain practices within the Irish fish farming industry; and his plans to review the reporting, monitoring and licensing roles of the various State Departments involved in the aquaculture area following the revelations from the same programme. I propose to take Questions Nos. 142, 144, 151, 164 and 171 together.

The position with regard to the various reviews and investigations that are currently ongoing in respect of matters related to aquaculture was set out in my reply to Questions Nos. 113, 115 and 117 of 7 October 2003. The detailed review of existing systems and procedures for monitoring, control and enforcement in respect of aquaculture is under way in my Department and the aim is to have it finalised when the Marine Institute investigation into mortalities on salmon farms is completed.

A specific instance of the alleged inappropriate disposal of fish mortalities has been the subject of consultations with the legal services and a full determination as to the further action to be taken is awaited. In the circumstances, it would not be appropriate for me to comment further on the particular case. No other cases have come to attention to date in which it was considered that the institution of a prosecution in accordance with the Fisheries (Amendment) Act 1997 would be appropriate. In the event that any matter comes to light, which would appear to warrant legal action, the position as regards the initiation of prosecution will be considered in conjunction with the legal services. I do not consider it appropriate at this juncture to comment on matters relating to the membership of State boards.
