173 Mr. Sargent asked the Minister for Communications, Marine and Natural Resources if his Department will be making a submission to the Broadcasting Commission with regard to the establishment of new guidelines governing children's advertising on television; and if he has another consultative role in the process for the establishment of the guidelines. [26348/03]

As I outlined in my reply to Parliamentary Question No. 164 on 7 October 2003, I will not be making a submission to the Broadcasting Commission of Ireland in relation to the codes and rules on advertising which it is preparing. Through the Broadcasting Act 2001, the Oireachtas has provided that the preparation of the codes and rules is a matter for the commission, which is an independent statutory body. In the circumstances I consider it would be inappropriate for me to intervene in the matter.
