Ceist:

309 Mr. Naughten asked the Minister for Justice, Equality and Law Reform the reason a refugee application by a person (details supplied) was not sent to the Appeals Tribunal; and if he will make a statement on the matter. [29295/03]

I wish to inform the Deputy that the person concerned entered the State on 30 December 2000 approximately, and claimed asylum.

On 1 June 2001, the Office of the Refugee Applications Commissioner notified the individual that her application was deemed manifestly unfounded. This recommendation was subsequently appealed to the Refugee Appeals Tribunal who set aside the decision of the Refugee Applications Commissioner. The application was resubmitted to the Refugee Applications Commissioner for further consideration.

After substantive consideration of the case, the Office of the Refugee Applications Commissioner issued a refusal on 28 June 2002. The Refugee Appeals Tribunal has no record of an appeal being received in respect of the substantive recommendation of the Office of the Refugee Applications Commissioner.
