Written Answers. - Social Welfare Appeals.

Ceist:

447 Mr. Ring asked the Minister for Social and Family Affairs when a disability benefit appeal will be heard for a person (details supplied) in County Mayo; and if an early appeal can be arranged. [29684/03]

The payment of disability benefit to the person concerned was discontinued from 19 November 2003 following an examination by a medical assessor of the Department who expressed the opinion that she was capable of work.

The person's appeal against this decision was received in the social welfare appeals office on 26 November 2003. In the context of her appeal she will be examined by another medical assessor. She will be notified when this examination is arranged.

The person is in receipt of unemployment benefit pending the resolution of her appeal. Under social welfare legislation, decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
