SEANAD IN COMMITTEE. - LOCAL GOVERNMENT (COLLECTION OF RATES) BILL, 1923.—(COMMITTEE STAGE.)

SECTION 2.

There is an amendment in my name to this Section. I understand that the Government wish to consider it, and in that case it could, with the permission of the Seanad, be brought up again on the Report Stage.

SECTION 4.

In connection with Section 4, there appears to be no machinery by which the party, whose name it is proposed to delete from the Rate Book, can be called upon to appear and make his case. I do not know the technical bearing of it, but it does seem as if that matter should receive further consideration from the Government.

AN CATHAOIRLEACH

I intended to call the attention of the Minister to the matter, because I think it is a very strong provision to say that the name of an existing rated occupier is to be struck out and a fresh and different name inserted without giving the actual rated occupier an opportunity of being heard. Further, I think it would be very desirable if some form of appeal was provided in the case of this drastic provision. That is a matter that the Government, perhaps, might consider between this and the Report Stage.

SECTION 5.

I think in Subsection 2 the service mentioned would not be sufficiently proved by a notice being posted by a clerk. I think the word "registered" should be put before envelope.

You would like to insert the word "registered" before envelope?

I think it would be necessary.

I think that is a desirable suggestion.

It can be dealt with on Report Stage. It cannot do any harm and will improve the Section.
