PUBLIC BUSINESS. - BODIES CORPORATE (EXECUTORS AND ADMINISTRATORS) BILL, 1928—FIFTH STAGE.

Question proposed: "That the Bill be received for final consideration and do now pass."

CATHAOIRLEACH

Serious doubts have been expressed by some people as to whether there would be unlimited power under this Bill for an executor or administrator acting under it to dictate his own fees and charges. Am I right in saying that they are regulated by statute and are subject to taxation?

An executor cannot get any charges at all unless they are left in the will. It has to be arranged. If no fee is left in the will the corporate body can get no fees legally. They may make an arrangement for a person interested to act for them.

CATHAOIRLEACH

What about an administrator?

I understand that he cannot get fees. The cases where a corporate body could act as administrators are, I think, only those cases where they are interested.

CATHAOIRLEACH

I do not think I made the point quite clear. Executors and administrators never get fees unless they are specially provided in the will. I am talking of executors' and administrators' solicitors. Am I right in saying that their fees are controlled and are subject to the Taxing Master?

That is so.

CATHAOIRLEACH

They are subject to control, and there is no fear of extortion or anything of that kind.

That is so.
