Public Business. - Seanad Election Motion, 1934.

I move:—

De bhri go bhforáltar le fo-alt (2) d'alt 5 d'Acht Toghacháin an tSeanaid, 1928, go ndéanfaidh Seanad Eireann ar dháta atá órduithe sa bhfo-alt san agus a bheidh roimh Thoghachán Seanaid, nó roimh an dáta san, agus iad ag vótáil do réir phrínsiobal na hionadaíochta cothromúla, oiread daonine cáilithe is bheidh de bhaill le togha sa toghachán san d'ainmniú chun a gcurtha ar an ainmliost d'iarrthóirí don toghachán san;

Agus de bhri go bhforáltar le fo-alt (3) den alt san 5 go socróidh Seanad Eireann an modh ina dtairgfear agus ina roghnófar daoine chun a n-ainmnithe amhlaidh ag Seanad Eireann;

Anois ar an abhar san deineann Seanad Eireann a bheartú tré rún agus a shocrú leis seo gurb é slí ina ndéanfaidh Seanad Eireann an tairisgint agus an roghnú i gcóir an ainmniúcháin sin ná do réir na Rialacha a hórduitear sa Rún um Thoghachán an tSeanaid, 1931, do rith Seanad Eireann an 14o Deire Fómhair, 1931, ach na hatharuithe seo leanas do bheith déanta ortha:—

(a) Ní bheidh feidhm ag Riail 6 de sna Rialacha san agus ina hionad san beidh éifeacht ag an Riail seo leanas, sé sin le rá:—

"Cuirfidh an Ceann Cóimhrimh fé ndeár go dtabharfar páipéar tairisginte d'aon tSeanadóir go dteastóidh san uaidh i rith na tréimhse thosnóidh an 23o lá de Lúnasa, 1934, agus a chríochnóidh ar a 12 a chlog, meán lae, an 19o lá de Mheán Fhómhair, 1934, tréimhse dá ngairmtear anso ‘am an roghnúcháin.'"

(b) Ní bheidh feidhm ag Riail 8 de sna Rialacha san.

(c) Ní bheidh feidhm ag Rialacha 13 go 17, agus an dá riail sin d'áireamh, de sna Rialacha san, agus ina n-ionad san beidh éifeacht ag an Riail seo leanas, sé sin le rá:—

"Chó luath agus is féidir é tar éis ama an roghnúcháin do bheith caithte cuirfidh an Ceann Cóimhrimh fé ndeár páipéar vótála amháin agus dearbhú céannachta amháin do chur chun gach Seanadóra, ag á ghnáth-sheoladh, nó go dtí pé seoladh eile do bhéarfaidh uaidh, agus na Rialacha atá sa Cheathrú Sceideal a ghabhann leis an Acht Timpeal Toghacháin, 1923 i dtaobh post-vótála agus na fuirmeacha a hórduítear ina cóir sin beidh feidhm acu ach na hatharuithe is gá do bheith déanta ortha agus go sonnrách an t-atharú go gciallóidh an focal ‘gníomhaire', i ngach áit ina bhfuil sé sa Cheathrú Sceideal san, Seanadóir gur mian leis bheith i láthair agus is iarrthóir é féin nó is tairgtheoir no cuiditheoir iarrthóra."

(d) Ní tabharfar áird ar aon pháipéar vótála do gheobhfar tar éis a 12 a chlog, meán lae, an 6o lá de Mhí na Samhna, 1934.

(e) Seanadóir gur mian leis bheith i láthair agus is iarrthóir é féin nó is tairgtheoir nó cuiditheoir iarrthóra féadfaidh bheith i láthair le linn cóimhreamh na vótanna.

Féadfar an Rún um Thoghachán an tSeanaid, 1934 do bhairm den Rún so.

Whereas it is provided by subsection (2) of Section 5 of the Seanad Electoral Act, 1928, that on or before a date therein specified preceding a Seanad election as many qualified persons as there are members to be elected at such election shall be nominated by Seanad Eireann voting on principles of proportional representation for inclusion in the panel of candidates for such election;

And whereas it is provided by subsection (3) of the said Section 5 that the method of proposal and selection of persons for such nomination by Seanad Eireann shall be decided by Seanad Eireann:

Now therefore Seanad Eireann doth hereby resolve and decide that the proposal and selection for such nomination by Seanad Eireann shall be conducted in accordance with the rules prescribed in the Seanad Election Resolution, 1931, passed by Seanad Eireann on the 14th October, 1931, with the following modifications:—

(a) Rule 6 of the said rules shall not apply, and in lieu thereof the following rule shall have effect, that is to say:—

"The returning officer shall cause a proposal paper to be supplied to any Senator requiring the same during the period commencing on the 23rd day of August, 1934, and ending at 12 o'clock, noon, on the 19th day of September, 1934, which period is herein referred to as ‘the time for selection.'"

(b) Rule 8 of the said rules shall not apply.

(c) Rules 13 to 17 inclusive of the said rules shall not apply, and in lieu thereof the following rule shall have effect, that is to say:—

"As soon as may be after the expiration of the time for selection, the returning officer shall cause to be sent to each Senator, at his ordinary address, or to such other address as may be furnished by him, one voting paper and declaration of identity, and the rules in the Fourth Schedule to the Electoral Act, 1923, relating to postal voting and the forms prescribed therefor shall apply with the necessary modifications, and in particular the modification that the word ‘agent' where it occurs in the said Fourth Schedule shall mean a Senator who may desire to be present and who is either himself a candidate or the proposer or seconder of a candidate."

(d) Any voting paper received after 12 o'clock, noon, on the 6th day of November, 1934, shall be disregarded.

(e) A Senator who may desire to be present and who is either himself a candidate or the proposer or seconder of a candidate may attend the counting of the votes.

This resolution may be cited as the Seanad Election Resolution, 1934.

The wording of this motion is not in the usual form, but I suppose there is no real change in the conditions with which we are all familiar.

There is a bit of a change in the wording, but the conditions are exactly the same as heretofore?

They are the same as before. There is one difference —there may be postal voting under the proposed arrangement. Heretofore, postal voting was not in operation.
