Vol. 46 No. 13

Animal Remedies Bill, 1956—Report and Final Stages.

I move amendment No. 1:—

In page 3, Section 5, sub-section (1) (c) as amended in Committee, to insert before sub-section (ii) a new subparagraph as follows:—

( ) In a case where the remedy is manufactured in the State and is marketed under a Trade Mark registered in the State the name and address of the distributor.

I set down this amendment because it appeared to me that, as drafted the section did not cover all the matters which might arise in regard to trade marks. I have been informed that my amendment would not be necessary and, therefore, I propose to withdraw it.

Amendment, by leave, withdrawn.
Government amendment No. 2:—
In page 3, Section 5, sub-section (1) (c), as amended in Committee, in subparagraph (ii) to insert "or, where the remedy is not distributed by the manufacturer or packer, of the distributor" after "packer".

I offer this amendment to the Seanad in an effort to meet points raised by Senator McGuire, Senator Stanford, and, I think, Senator Cox, on Committee Stage. I think it does substantially meet the points raised by them.

I should like to thank the Minister for going so far and taking such trouble in meeting these very complicated points.

I should like to associate myself with what Senator Stanford has said. I think we have had a very happy experience on this Bill in that the Minister has been so accommodating. The case made by the trade was a fair one and the Minister has met the case very fairly, and I hope some other Ministers will take notice of that in the future.

Amendment agreed to.
Bill, as amended, received for final consideration and passed.
Ordered: That the Bill be returned to the Dáil.
