Industrial and Provident Societies (Amendment) Bill, 1978: Report and Final Stages.

Government amendment No. 1:
In page 18, to delete lines 4 to 13 and substitute the following:
"(4) (a) The income and expenditure account and balance sheet of a society shall be in such form and shall contain such particulars as the Minister may specify by regulations, either generally or with respect to a specified class or classes of societies, denoted by reference to such matters as the Minister thinks fit.
(b) Unless the Minister otherwise specifies in the regulations aforesaid, the income and expenditure account and the balance sheet of a society for any financial year shall include corresponding particulars for the preceding financial year.".

There are two corrections to the amendments as they appear in front of the Senators. First of all, "section 30" should be written above both amendments and in amendment No. 2 "In page 18 between lines 15 and 16 to insert the following." there are two words which are left out: "new subsection", which should be added and, if they are acceptable to the Senators, perhaps we could include them at this stage. Senator FitzGerald made——

If I may interrupt the Minister, on the Report Stage neither of these corrections is necessary.

Thank you. I was just saying that Senator FitzGerald made a very valuable contribution here this afternoon on the Bill. As a result of the points he raised, particularly on this section, it was decided that the amendments should be made. In fact, the amendments are in line, as the Senator correctly pointed out, with the relevant section in the Companies Act.

I welcome these amendments. I made a number of points on different sections, in particular on the interpretation section, section 2, section 7, section 25 and section 36 and this section. I have considered what the Minister said on these points and absorbed other information since she made these remarks and I am satisfied that the sections in the Bill as amended are in the public interest.

Government amendment No. 2:
In page 18, between lines 15 and 16, to inser the following:
"(6) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next 21 days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to anything previously done thereunder.".
Amendment agreed to.
Bill, as amended, received for final consideration and passed.
