Vol. 228 No. 9

Companies (Miscellaneous Provisions) Bill 2013: [Seanad Bill amended by the Dáil] Report and Final Stages

I welcome the Minister of State. This is a Seanad Bill which has been amended by the Dáil. In accordance with Standing Order 118, it is deemed to have passed its First, Second and Third Stages in the Seanad and is placed on the Order Paper for Report Stage. On the question "That the Bill be received for final consideration", the Minister of State may explain the purpose of the amendment made by the Dáil. This is looked upon as the report of the Dáil amendment to the Seanad. For Senators' convenience, I have arranged for the printing and circulation of the amendment to them. Each Senator may contribute only once. I remind Senators that the only matter which may be discussed is the amendment made by the Dáil.

Question proposed: "That the Bill be received for final consideration."

Amendment No. 1 provides that the regulations which it is proposed that the Minister be empowered to make under section 8(2) will be laid before the Houses of the Oireachtas. The regulations in question permit the Minister to provide that the Irish Auditing and Accounting Supervisory Authority can apply its systems of investigations and penalties to auditors and audit firms or firms listed in this jurisdiction from specific third countries. The amendment is in response to an amendment which was proposed by Senator Barrett on Report Stage in the Seanad but which could not be facilitated at that time. It is appropriate to include the new amendment because it will allow for the laying of regulations made under section 8(2) before the Houses of the Oireachtas.
