SECTION 40.

We now come to amendment No. 120 in the name of the Minister. Amendment No. 121 is an alternative and amendment No. 124 is related. It is proposed to take amendments Nos. 120, 121 and 124 together.

I move amendment No. 120:

In page 28, subsection (1), line 34, to delete "ten days" and substitute "10".

This is a drafting amendment. Some time ago there was great disparity in the sections as to the time allowed for carrying out certain functions. We talked it through in consultation with the officials and finally decided to introduce a standard ten day period for giving notification, carrying out warning procedures and for deadlines to have consistency throughout the Bill and prevent confusion on the part of people responsible for implementing its provisions. Deputy Quill's amendment which asks for the deletion of "ten days" and the substitution of "twelve days, excluding Saturdays, Sundays and public holidays" does not seem relevant under the circumstances.

Question proposed: "That section 40, as amended, stand part of the Bill".

Section 40 provides for a signed statement of amounts paid and amounts, if any, due to be provided. This sounds like a provision aimed at money-lenders. Will it apply equally to banks and building societies?

This is a general provision.
