I move amendment No. 126:

In page 95, lines 34 to 38, to delete subsection (1).

Following publication of the Bill, my Department noticed an overlap between section 111, which provides that the registrar may determine the form and content of a credit union's annual income and expenditure account and balance sheet, and section 121(1) which similarly indicates that the Minister may determine these matters. In order to clarify the matter I am proposing, in these amendments, to remove reference to the Minister having the required power to determine the form and content of the income and expenditure account and balance sheet of a credit union.

In page 96, subsection (2), line 4, to delete "further".

In page 96, subsection (2)(b), line 12, after "accounts;" to insert "and".

The three amendments to subsection 2 of section 121 all relate to my proposed deletion of paragraph (d) from the subsection. The Irish League of Credit Unions considered that it was highly unusual for the Minister to take it upon himself to specify a programme of audit procedures in a credit union or in any similar legal entity. As it is not an issue of substance from my perspective, I have decided to delete the offending paragraph in deference to the view of the Irish League of Credit Unions.
