SECTION 5.

(1) The Executive Council shall appoint a fit and proper person to be standing arbitrator (in this Part of this Act referred to as the arbitrator) for the purposes of this Part of this Act.

(2) Every person appointed under this section to be a standing arbitrator shall hold that office for five years from the date of his appointment and no longer, but shall be eligible for re-appointment at the end of his term of office or at any subsequent time.

(3) Every person appointed under this section to be a standing arbitrator may be removed from that office at any time by the Executive Council for stated misbehaviour or incapacity, but not otherwise.

(4) There shall be paid to the arbitrator appointed under this section such remuneration as the Minister, with the sanction of the Minister for Finance, shall determine.

I propose:—

To add at the end of sub-section (1), line 61, the words " In making the appointment the Executive Council shall consult and obtain the views of the National Dairy Council to be appointed under this Act."

I understand that the Minister has promised to create some kind of an Advisory Council or National Dairy Council. And I think there will be a general agreement that that should be done under this Bill, and, that being so, that the person appointed should be appointed after consultation with such National Council or Advisory Council. Otherwise it would mean that such an appointment would be made on the recommendation of officials of the Department : and that might not lead to the best of good feeling. That is the reason I propose the amendment.

Is there anything in the Act which establishes a National Dairy Council?

Deputy MILROY

I have a further amendment.

Are we not asked to discuss the whole question of the establishment of a National Dairy Council on this amendment?

CHAIRMAN

Deputy Heffernan has a similar amendment:—

A vocational Advisory Council shall be appointed by the Minister and shall consist of representatives selected from the various interests engaged in the industry, and shall advise the Minister on all matters concerning the working of the Act, and shall be consulted by him on the making of any regulations under this Act. The members of the Council shall hold office for a period of two years and shall be eligible for re-appointment.

There is also an amendment in the Green Paper—amendment 57. Would it not be better to postpone the discussion on this until we discuss the question as to whether or not there will be a Dairy Council? If the principal of a National Dairy Council were accepted this amendment could be brought in on Report and discussed.

Deputy MILROY

It would rather stultify ourselves if we discussed this and passed it, and ultimately decided not to have a National Council. The proper procedure is to withdraw the amendment.

CHAIRMAN

There is no guarantee given that it will not be opposed on Report even if the other passed.
