Special Committee Family Law (Maintenance of Spouses and Children) Bill, 1975 díospóireacht -
Tuesday, 25 Nov 1975

SECTION 11.

Question proposed : " That section 11 stand part of the Bill."

This is unusual in that it provides for the cost after the payment of the order—that is that the money be applied first to discharge the order and secondly any costs.

The District Court clerk could then apply for more than the actual weekly sum?

The amount to cover costs would be ordered by the court in advance.

The District Court clerk can then attach them as well as the actual maintenance sum?

He can: for example, an order for say, £20 a week and £10 for costs the first week if only £20 comes in he would appropriate that to pay a week's maintenance order rather than pay the £10 for the costs.

In relation to costs what is the up-to-date position? Would that be dealt with on a scale of costs on these matters?

Rules are being drafted according to various administrative matters that arise from this Bill.

Question put and agreed to.
