SECTION 73.

(7) Whenever the Minister acquires under this section any land which is subject, either alone or in conjunction with other land, to a purchase annuity, payment in lieu of rent, or other annual sum (not being merely rent under a contract of tenancy) payable to the Irish Land Commission, the Minister shall become and be liable, as from the date on which the Minister enters on and takes possession of the land so acquired, for the payment to the Irish Land Commission of such purchase annuity, payment in lieu of rent or other annual sum (not being merely rent under a contract of tenancy) or such portion thereof as shall be apportioned by the Irish Land Commission on such land as if such land had been transferred to the Minister by the proprietor thereof on that date.

I move amendment No. 20:—

In sub-section (7), page 42, lines 56 and 61, to delete the word " sum " and substitute the word " payment."

This is a drafting amendment which is intended to bring the phraseology into line with that used in the Land Acts. I gather that the word " sum " would not cover certain matters which it was intended this sub-section should cover.

The McGillycuddy

Perhaps the Minister would look into sub-section (2). I have already mentioned this matter to his Department because it might lead to difficulty later. In thecase of one fishery, this provision could not be operated. The Minister prevents himself in sub-section (2) from going on to any enclosed premises, yard or garden. It would be quite impossible for him to approach Waterville fishery under these circumstances. The actual storage hatch is 27 yards from Mr. Butler's door and the first crib 34 yards. On both sides it is enclosed, with no possible means of getting down the avenue. It would probably be a matter for arrangement with the owner, but there might be difficulty if the matter were not considered further.
