Lenihan asked the Minister for Justice, Equality and Law Reform the figures available to his Department regarding the deportation orders served against illegal migrants resident in Ireland and the number of orders which were not served due to the disappearance of the people involved. Amharc ar fhreagraSection 3(2) of the Immigration Act 1999, as amended, allows the Minister for Justice, Equality and Law Reform to make deportation orders regarding nine categories of persons. Between the commencement of that Act in November 1999 and 31 December 2003, 7,892 such deportation orders were served. A breakdown of that number into the nine categories is not available: the vast majority of the orders were made regarding failed asylum seekers.
All deportation orders are served on the individuals concerned at their last given address with a requirement on them to present themselves to the Garda National Immigration Bureau, so that arrangements can be made for their removal from the State. Of the 7,892 persons who were notified of their deportation orders, 4608 failed to present themselves to the Garda National Immigration Bureau as required. Those persons are classified as evaders and, although it is not known how many actually remain in the State, they are subject to arrest and detention for the purposes of deportation.
