124 Mr. Broughan asked the Minister for Communications, Marine and Natural Resources the criteria and selection process used in the appointment of the second member of the Commission for Energy Regulation (details supplied); if the post was advertised; the reason the Civil Service and Local Appointments Commission was not asked to fill this position, as is happening with the third post; and if he will make a statement on the matter. The Schedule to the Electricity Regulation Act 1999 provides that each member of the Commission for Energy Regulation, CER, shall be appointed, on such terms and conditions of appointment, including remuneration, as the Minister for Communications, Marine and Natural Resources may fix, with the consent of the Minister for Finance. The appointment of Mr. Michael Tutty, as a second member of the CER, was made in accordance with those statutory provisions.

My predecessor apprised the Government of his decision in advance of the appointment, which was made with the agreement of the former Minister for Finance.
