508 Mr. J. Breen asked the Minister for Enterprise, Trade and Employment if the recommendation of Mr. Finbarr Flood of 8 November 2004, that a mechanism be put in place to address situations between pensioners and former employees, has been accepted by the Government; and if it will be implemented. In 2001 the Labour Court made a recommendation to the effect that a mechanism should be put in place to address situations of dispute between retired employees and their former employers. In 2002, the Pensions Act provided for the appointment of a pensions ombudsman with the power to investigate and determine matters regarding the administration and management of pension schemes. Situations may arise, however, where the dispute with a former employer does not relate to pension matters. My Department is reviewing policy on access to industrial relation machinery where the issue in dispute is not a pensions matter.
