509 Deputy Damien English asked the Minister for Justice, Equality and Law Reform the reason a person (details supplied), who has provided additional information as requested, is waiting for a decision on IBC/05; when this decision will be made; and if he will make a statement on the matter. Amharc ar fhreagraThe person concerned made an application for permission to remain in the State under the IBC/05 Scheme on 2 February 2005. It was a condition of the Scheme that the applicant had been resident in the State with their Irish born child, on a continuous basis, since the child's birth. The person's application was refused on the basis that she did not in fact meet this condition and she was advised of this decision on 13 December 2005.
My Department is currently awaiting the outcome of an appeal to the Supreme Court of matters related to the IBC/05 Scheme. The decision to refuse the person's application may be considered further in the context of that Judgment.
