252 Deputy Phil Hogan asked the Minister for Transport his views on whether a person who, a court has noted, as a director of a limited company failed to ensure that audited accounts were prepared and filed, as required by the Companies Act 1990, is suitable to act as chairman of a State company under the auspices of his Department; and if he will make a statement on the matter. 253 Deputy Phil Hogan asked the Minister for Transport the circumstances in which he would be prepared to seek the removal or resignation of a chairman or non-executive director of a State or semi-State company that comes within his Department’s remit; and if he will make a statement on the matter. I propose to take Questions Nos. 252 and 253 together.

Unless an individual is legally restricted from serving as a director, their suitability or otherwise to serve as a director or chairman of a State company under my Department would generally have to be dealt with on a case-by-case basis, having regard to the relevant statutory provisions.
