Amharc ar fhreagraI am advised by the Social Welfare Appeals Office that an Appeals Officer having fully considered all the available evidence, including that adduced at oral hearing, disallowed the appeal of the person concerned. The person concerned has been notified of the Appeals Officer's decision. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
377 Deputy Peter Mathews asked the Minister for Social Protection when a decision will issue on an appeal for domiciliary care allowance in respect of a person (details supplied) in County Meath; and if she will make a statement on the matter. [21731/12]
Amharc ar fhreagraThe continued entitlement of the person concerned to domiciliary care allowance was reviewed in December 2011. The case was referred to one of the Department's Medical Assessors who found that the child was no longer medically eligible for the allowance. The person concerned was notified of the decision on 7th December 2011 and she has appealed the decision. As part of the appeal process, the case has been forwarded to another of the Department's Medical Assessors for further consideration, including a review of any new information supplied. Upon receipt of the Medical Assessor's opinion, the case will be further examined and forwarded for consideration by the Appeals Office, if necessary.
