326 Deputy Brendan Griffin asked the Minister for Social Protection if all the evidence provided in a domiciliary care allowance appeal in respect of a person (details supplied) in County Kerry was taken in account when making the decision on this case. [26337/12]

An application for domiciliary care allowance (DCA) was received from the person in question on 28th July 2011. This application was referred to one of the Department's Medical Assessors who found that the child was not medically eligible for the allowance. A letter issued on 5th October 2011 refusing DCA. The person concerned subsequently lodged an appeal against the decision. He was informed by the Social Welfare Appeals Office on 11 May 2012 that the appeal had been disallowed. All of the information supplied in support of the DCA application was considered both by the Medical Assessor and the Appeals Officer.

The decision/appeal process for this application is now complete. If the person concerned has additional information which was not made available to the Deciding Officer and the Appeals Officer when they made their decision, it is open to him to re-apply.

329 Deputy Michelle Mulherin asked the Minister for Social Protection the position regarding an appeal against a refusal of a disability allowance application in respect of a person (details supplied) in County Mayo; and if she will make a statement on the matter. [26373/12]

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 12th December 2011. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. These papers were received in the Social Welfare Appeals Office and the case has been referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

332 Deputy Charlie McConalogue asked the Minister for Social Protection the position regarding a domiciliary care allowance application in respect of a person ( details supplied) in County Donegal; and if she will make a statement on the matter. [26393/12]

An application for domiciliary care allowance was received on 12th September 2011. This application was referred to one of the Department's Medical Assessors who found that the child was not medically eligible for the allowance. A letter issued on 15th November 2011 advising of the decision.

On 18th April 2012, the person concerned requested a review of the decision and the case has been forwarded to another of the Department's Medical Assessors for further consideration. Upon receipt of the Medical Assessor's opinion, the person concerned will be notified of the decision.
