508 Deputy Dominic Hannigan asked the Minister for Justice and Equality the regulations that govern ice cream vans; if they are county council by-laws or national legislation; if a person is making a complaint against the proprietor of an ice cream van the governing authority other than the owner of the van that is responsible; and if he will make a statement on the matter. I have to inform the Deputy that my Department has no role in overseeing the regulations that govern the operation of ice-cream vans. However, I understand that the legislation which establishes the regime for the regulation of selling goods in public places is the Casual Trading Act 1995. Section 2(1) of this Act defines casual trading as "selling goods at a place (including a public road) to which the public have access as of right or any other place that is a casual trading area". Casual trading is regulated by the 88 Local Authorities who have the legal capacity to make bye laws under the Act.
