Durkan asked the Minister for Social Protection if and when appeal and-or including oral hearing will be arranged in the case of a person (details supplied) in County Kildare; if she will accept this inquiry as a basis for appeal and oral hearing; and if she will make a statement on the matter. Amharc ar fhreagraInvalidity Pension is a payment for people who are permanently incapable for work because of illness or incapacity and who satisfy the contribution conditions. An invalidity pension claim in respect of the person concerned was disallowed on the grounds that she is not considered to be permanently incapable of work. The applicant was notified of this decision and the reason for it. The person concerned requested a review of this decision. She supplied further medical evidence with the request for review which has been forwarded to a medical assessor for opinion. On receipt of this opinion the deciding officer will review the decision and the applicant will be notified of the result. In the event that the original decision is upheld, the applicant will be advised of her right to appeal the decision to the independent social welfare appeals officer.
