547 Deputy Dara Calleary asked the Minister for Agriculture, Food and the Marine the position regarding whether the consent of the landowner is required when a dispute arises and farm payments continue to be paid by his Department, even though the land on which the animals are grazing are not owned or rented. Applicants under the Single Payment Scheme are required,inter alia, to declare one eligible hectare for each SPS payment entitlement held; in declaring such land, applicants are required to indicate whether the land is Owned, Rented or Leased. Where the same land parcel is claimed by more than one applicant, on the basis that the land is being leased/rented or a similar type transaction, the landowner will be required to make a formal declaration, in a format to be determined by my Department, as to the usage of the land in question. Essentially, the landowner will simply be asked to provide factual information in such cases.
