Deputy Anthony Lawlor asked the Minister for Education and Skills if the quality of windows installed in school extensions varies from the quality of windows installed in new build schools or if it is his policy to ensure that all windows installed in school building projects are of the same quality; and if he will make a statement on the matter. Guidance on the specification of windows to be installed in all school building projects is set out in Technical Guidance Document TGD021-1 which is available on my Department's website. These guidelines state the minimum standards to be used in the design and specification of new or replacement windows for use in educational facilities and should be read in conjunction with other relevant design guidance, also available on my Departments website. These guidelines do not set out the standard required for existing windows. These standards apply to all Primary and Post-primary construction projects funded in part or in whole by the Department of Education and Skills.

Arrangements to establish the Residential Institutions Statutory Fund are being pursued. I have nominated Sylda Langford to become Chairperson of the Board and in accordance with Government procedures, Ms Langford met with the Oireachtas Joint Committee on Education and Social Protection on February 20th to discuss the approach she will take as Chairperson and her views about the future contribution of the new organisation. The process to recruit a Chief Executive Officer (Designate) is also underway. I intend to commence the relevant legislation and appoint the Board shortly.

Under the Education Act 1998 (as amended by the Education (Amendment) Act 2012) it is the Board of Management or VEC, as appropriate, which is responsible for recruitment, selection, appointment, discipline and dismissal of staff in accordance with procedures published by the Department following consultation with the education partners. The terms and conditions of employment, including remuneration, and the numbers and qualifications of the teachers and other staff of a recognised school who are, or who are to be, remunerated out of monies provided by the Oireachtas, are determined from time to time by the Minister with the concurrence of the Minister for Public Expenditure and Reform.

On Tuesday 29th of January Minister Fitzgerald and I published the Action Plan on Bullying which sets out twelve actions to help prevent and tackle bullying in primary and second level schools. I have ring-fenced €500,000 to support implementation of these actions this year. Officials from my Department have already commenced work on the implementation of the actions. In particular, an awareness raising initiative on cyber bullying targeted at young people is already underway and the Department is supporting the Stand Up! Awareness Week Against Homophobic & Transphobic Bullying in second level schools in March. Work will continue on implementing the Action Plan on Bullying in the coming months.

Deputy Patrick Nulty asked the Minister for Education and Skills if he will confirm that the student assistance fund will not expire for the 2013/14 academic year and that it will continue in place; his views on whether there is an even greater need for the fund in the current economic circumstances in view of the increase in numbers of students availing or attempting to avail of the fund recently; and if he will make a statement on the matter. The objective of the Student Assistance Fund is to assist students, in a sensitive and compassionate manner, who might otherwise, due to their financial circumstances, be unable to continue their third level studies. The Fund is managed by the Higher Education Authority (HEA) on behalf of my Department and is funded under the National Development Plan, with assistance from the European Social Fund. A survey conducted by the HEA in November 2012 showed that the higher education sector is experiencing a significant increase in demand for the Fund over last year. In response to the increased demand, I approved an additional €3m to supplement the Fund, which was allocated in December 2012, bringing the total allocation for 2012-13 to €11m. The Fund is expected to assist in the region of 16,000 students this academic year. I have no plans at present to discontinue the Student Assistance Fund.

In accordance with Government policy, expressions of interest have been sought through the Public Appointments Service (PAS) from suitably qualified and experienced persons for consideration for appointment to the following boards of Bodies operating under the aegis of my Department: Leárgas Ltd – The Exchange Bureau; The Higher Education Authority (HEA); Quality and Qualifications Ireland (QQI); The National Council for Curriculum and Assessment (NCCA); The State Examinations Commission (SEC); The Teaching Council; Grangegorman Development Agency (GDA); National Council for Special Education (NCSE). Three appointments were made to the Board of Foras Áiseanna Saothair (FÁS), these vacancies were not published on PAS. Appointments to the Board of FÁS were made after consultation with the Minister for Social Protection and the Minister for Jobs, Enterprise and Innovation. It should be noted that Board appointments, while made by me as Minister, are not in all cases made at my sole discretion. Individuals may be nominated for appointment by various organisations as specified in the relevant statute of the body concerned. The Deputy should further note that in making any direct Ministerial appointments, I am not necessarily confined to those who make such expressions of interest but will ensure that all of those appointed have the relevant skills and competencies for the positions. The information requested on the number of appointments made from members of the public who applied through the PAS process is outlined in the attached table.

I wish to advise the Deputy that the National Council for Special Education (NCSE) is responsible, through its network of local Special Educational Needs Organisers (SENOs), for processing applications from schools for special educational needs supports, including Special Needs Assistant (SNA) support. The NCSE operates within my Department's established criteria for the allocation of such supports and the staffing resources available to my Department. All schools were advised to apply to the NCSE for resource teaching and SNA support for the 2012/13 school year by 16th March, 2012.

All schools, including the school referred to by the Deputy, have been advised by the NCSE of their resource teaching and SNA staffing allocation for the current school year. Details of the allocations which have been made to each school are available at www.ncse.ie.

All primary schools receive a quantum of resource hours for children with special educational needs through the General Allocation Model and also through individual allocations for children with low incidence special needs. The NCSE allocates a level of SNA support for each school annually taking into account the care needs of all of the qualifying children enrolled in the school. SNAs should then be deployed by schools in a manner which best meets the care support requirements of the children enrolled in the school for whom SNA support has been allocated. It is a matter for schools to allocate support as required, and on the basis of individual need, which allows schools flexibility in how the SNA support is utilised. Where schools have enrolled new pupils with special educational needs who were not considered at the time that the allocations for the 2012/13 school year were made, or where schools are in a position to demonstrate that they cannot cater for the care needs of qualifying children from the level of SNA support which has been assigned to them, they may apply to the NCSE for additional SNA support or for a review of their SNA allocation.

Similarly where SNA support was not initially allocated for a child in a junior infant class, but where it can be demonstrated that the child requires SNA assistance in the classroom environment, the school may apply to the NCSE for additional SNA support or for a review of their SNA allocation. All schools have the names and contact details of their local SENO. Parents may also contact their local SENO directly to discuss their child's special educational needs, using the contact details available on www.ncse.ie.

Bullying in Schools

Under the Education (Welfare) Act 2000, all schools are required to have in place a Code of Behaviour and this code must be drawn up in accordance with the guidelines of the National Educational Welfare Board (NEWB). The NEWB guidelines were issued to schools in 2008 and make it clear that each school must have policies to prevent or address bullying and harassment and schools must make clear in their code of behaviour that bullying is unacceptable. The guidelines further state that as well as making explicit that bullying is prohibited in the school, and having an anti-bullying policy, the code of behaviour should indicate what action the school will take in relation to alleged breaches of the school's bullying policy. Every school therefore must have in place a policy, within the framework of the school's overall school code of behaviour, which includes specific measures to deal with bullying behaviour. Such a code, developed through consultation with the whole school community and properly implemented, can be the most influential measure in countering bullying behaviour in schools.

I am fully aware of the seriousness of the issue of bullying and it was for that reason that an Anti-Bullying Forum was held in May last year. The Deputy will be aware that I established a working group to address the issue of tackling bullying in schools, including cyber-bullying. The Group produced an Action Plan recommending further measures that can be taken to effectively tackle bullying, including cyber bullying, in schools. I broadly accept the proposed actions in the Action Plan which was published in January. I have asked officials in my Department to commence work on implementing the Action Plan in consultation with teachers, parents and management bodies at first and second-level schools. My Department's role is to clarify for parents and students how their grievances and complaints against schools can be progressed. Guidance to parents on progressing a concern in relation their child's school is available on my Department's website at www.education.ie. Where a parent feels that the school's board of management has failed to investigate or adequately investigate their complaint, they should contact the Ombudsman for Children. The Office of the Ombudsman for Children may independently investigate complaints about schools recognised with the Department of Education and Skills, provided the parent has firstly and fully followed the school's complaints procedures. The key criterion for any intervention by the Ombudsman for Children is that the action of the school has had a negative effect on a child. The management authority of each school carries responsibility for making decisions regarding the Transition Year Programme in that school. In some schools, the programme is compulsory for all students. In those that offer it as an option, circumstances may arise where it is necessary to limit the number of students who can avail of it. It is the board of management of each individual school that decides the number of places available to students on programmes such as Transition Year. In cases where restrictions apply, schools should have clear procedures regarding how places are allocated to students.

There are a range of foreign languages available on the curriculum in schools -- French, German, Spanish, Italian, Russian, Japanese and Arabic. Chinese is not currently on the curriculum. It is not possible in the current budgetary situation to expand the range of languages available in the post primary curriculum. However, the availability of Transition Year and the option for the NCCA or others, including schools, to developed short courses proposed as part of junior cycle reform will, in the future, give opportunities for the development of additional languages, including Chinese. The NCCA is developing a short course in Chinese which should be available in schools from September 2014.

My Department will fund over 430,000 part time and full time education and training places across the range of provision in the higher education, further education and training sectors in 2013 and unemployed participants are prioritised for places in further education and training.

1) Further Education provision

The main providers of FE programmes are Vocational Education Committees (VECs). Programmes are usually certified by the Further Education and Training Awards Council (FETAC) and certification is available for all FE learners. Full-time programmes are: Youthreach, for early school leavers between 15 – 20 years of age; Vocational Training Opportunities Scheme (VTOS) for unemployed adults over 21 years of age; Post Leaving Certificate (PLC) for learners over 16 years of age who have completed the Leaving Certificate (LC) or who are adults returning to education. Part-time programmes are provided under: The Back to Education Initiative (BTEI), free for adults with a less than upper second level education; Adult Literacy (AL) for adults with specific needs in basic skills areas and includes English as a Second Language (ESOL) provision; Community Education (CE) providing informal and non-formal education for hard-to-reach adults.

2) FAS/SOLAS Training services

FÁS Training Services will facilitate unemployed individuals through a range of training programmes that provide industry/occupational specific skills as well as preparatory type training, to enable a diverse range of unemployed individuals referred to FÁS through "Intreo", to gain a recognised qualification, access job opportunities or progression opportunities to further/higher education/training.

3) Redundant Apprentice Placement Scheme (RAPS)

FÁS the National Training and Employment Authority introduced the Redundant Apprentice Placement Scheme in 2011 (RAPS) to provide redundant apprentices with the opportunity to complete the minimum on-the-job training with assessments for Phase 3, Phase 5 and Phase 7 of the Standard Based Apprenticeship Programme. This Programme was extended in 2012 and there were over 2,200 beneficiaries. RAPS will continue in 2013.

4) Skillnets

Skillnets which is an enterprise-led body funded through the National Training Fund (NTF) to provide companies with new opportunities to develop relevant, effective answers to their training and development needs was set ambitious targets for 2013 to train 40,000 persons, of which up to 8,000 will be unemployed.

5) Momentum

"Momentum" has been designed to provide targeted interventions to tackle the skills shortages in particular sectors of the Irish economy where vacancies have been identified and will provide up to 6,500 training places for the long term unemployed. Some of the places have been targeted specifically at young unemployed people. Momentum will be co-financed by the European Social Fund.

6) National Strategy for Higher Education

National Strategy for Higher Education is a detailed framework and range of recommendations that ensures the system continues to respond to enterprise needs. This includes structured employer surveys and interaction, increased work placement opportunities, staff mobility into enterprise and a renewed focus on generic skills. The Higher Education Authority has also published guidelines for the establishment of higher education institutional clusters at a regional level to support enterprise development and employment needs.

7) Springboard

Springboard is a new funding stream that has been introduced since 2011 to address the specific skills needs of enterprise and to support jobseekers to re-skill in areas where employment opportunities are emerging as the economy is recovering. To date more than 10,000 unemployed or previously self employed people have been provided places under Springboard and a further 5,000 places are expected to be delivered in 2013.

8) ICT Skills

A joint Government-Industry ICT Action Plan, which has been developed as a direct response to identified ICT skills shortages, contains a comprehensive range of measures to build the domestic supply of ICT graduates.

I wish to advise the Deputy that my Department has been working closely with South Dublin County Council for some time in relation to identifying and acquiring a suitable site for the provision of permanent accommodation for two new schools planned to open to serve the Firhouse/Oldbawn area. I am advised that current plans in relation to the two schools involve developing a site of approximately 6 acres. My officials were recently made aware that some opposition in relation to the proposal has arisen locally. I understand that my officials and South Dublin County Council are continuing to discuss the matter.

Grants in the Education Sector for the Per Cent for Art Scheme are available for major school projects only. Eligible major school projects are not refused the grant. Works carried out under the Devolved Minor Grant Scheme or Summer Works Scheme are not eligible for grant aid under the scheme. The limits under the scheme are set to a maximum of 1% of the overall VAT exclusive construction cost which in turn is subject to various limits. The amount of funding available for eligible construction projects is set as follows: Projects costing up to €2,550,000 - 1% of net construction cost up to a maximum limit of €25,500; Projects costing between €2,550,000 and €6,300,000 - 1% of net construction cost up to a maximum limit of €38,000; Projects costing between €6,300,000 and €12,700,000 – 1% of net construction cost up to a maximum limit of €51,000 and Projects costing in excess of €12,700,000 – 1% of net construction cost up to a maximum limit of €64,000.

221. Deputy Seán Kyne asked the Minister for Education and Skills the progress of the replacement scheme for pre-fabs operated by the Department. [11609/13]

Under my Department's Prefab Replacement Initiative announced in March 2012 over 170 schools have been approved to replace their rented prefab accommodation with permanent. In excess of €42million has been allocated for this initiative of which €19.7 million has been paid to date. Funding is provided in two traunches, 70% when the project goes to construction and the remaining 30% on completion. A total of 104 schools have already gone to construction and 10 of these have been completed. The rental savings achieved by the 10 completed projects are in the region of €118,000.00. These figures will be subject to change as further projects are completed. This funding is being provided to schools to replace rented prefabs that are currently providing mainstream classroom and resource rooms for an estimated 6,000 pupils. In total 286 mainstream classrooms currently in rented prefabs will receive permanent buildings. Resource rooms and other ancillary accommodation will also be replaced as part of this initiative and a rental saving of up to €5m will be achieved when all the projects are completed.
