Social Welfare Benefits Eligibility

349. Deputy Catherine Murphy asked the Minister for Social Protection the circumstances under which it is considered acceptable and legal to temporarily withdraw jobseeker's benefit or allowance from a person; the number of cases in the past year in which this has occurred; if this practice is compatible with her obligation to ensure that no person falls below a certain guaranteed minimum income deemed necessary to maintain a minimum basic standard of living; and if she will make a statement on the matter. The jobseeker’s benefit and jobseeker’s allowance schemes provide income support for people who have lost work and are unable to find alternative employment. The revised estimates for the Department of Social Protection provide for expenditure of €3.3bn in 2014 in respect of the jobseeker’s schemes.

It is a fundamental qualifying condition for these schemes that a person must be available for and genuinely seeking full-time work. The schemes also require that persons must be fully unemployed for at least four in any seven consecutive days. In the case of jobseeker’s benefit, they must also satisfy social insurance contribution and substantial loss of employment conditionality. In the case of jobseeker’s allowance they must satisfy a means test. Claimants are also required to comply with activation measures.

The full scheme criteria are established in the Social Welfare (Consolidation) Act 2005, as amended and associated regulations. These provisions inform detailed scheme guidelines which are available, along with further information on the schemes, at www.welfare.ie.

Generally, entitlement under the schemes is withdrawn as a result of failure on the part of a claimant to satisfy scheme criteria. Consistent with the objective of operating the schemes efficiently and effectively such withdrawals may be temporary in nature or a full disallowance may be imposed depending on the circumstances of an individual case.

Given the range of circumstances under which person may cease to have an entitlement under the schemes more specific information would be required from the Deputy before statistics could be provided in this regard.

Where an individual does not have entitlement under jobseeker’s benefit or allowance, they may be eligible for the supplementary welfare allowance (SWA) scheme, which is considered the "safety net" within the overall social welfare system. The SWA scheme provides assistance to eligible people in the State whose means are insufficient to meet their needs and those of their dependants. The main purpose of the scheme is to provide immediate and flexible assistance for those in need who do not qualify for payment under other State schemes.

A person who is not satisfied with the outcome of their claim for a payment under the jobseeker’s or SWA schemes has the right to appeal against the decision to the independent social welfare appeals office.

Rent Supplement Scheme Administration

The purpose of the rent supplement scheme is to provide short-term income support to assist with reasonable accommodation costs of eligible people living in private rented accommodation who are unable to provide for their accommodation costs from their own resources. The overall aim is to provide short term assistance, and not to act as an alternative to the other social housing schemes operated by the Exchequer. There are currently approximately 77,000 rent supplement recipients for which the Government has provided over €344 million for 2014. In general there is no restriction on the geographic areas where persons may receive rent supplement. However Section 25 of the Social Welfare and Pensions Act 2007 provides that a payment of rent supplement shall not be payable in respect of accommodation which is situated in an area notified to the Minister for Social Protection by the Minister for the Environment, Community and Local Government, as being an area of regeneration for the purpose of providing for greater social integration. Rent supplement is not paid in respect of accommodation situated in the Ballymun regeneration area, as outlined by the Minister for Environment, Community and Local Government in this regard.

I can confirm that the Department’s Facilities Management Unit does not hold a file relating to the issue raised. OPW is responsible for the Department’s Property Management issues and may have some relevant documentation.

Domiciliary Care Allowance Applications

The most recent application for domiciliary care allowance (DCA) was received from the person concerned on the 24th March 2014. This application has been forwarded to one of the Department’s Medical Assessors for their medical opinion. Upon receipt of this opinion, a decision will be made and notified to the person concerned. It currently takes 10 weeks to process an application for DCA.

Supplementary Welfare Allowance Payments

The person concerned is currently in receipt of a basic supplementary welfare allowance of €186.00 per week which is the maximum rate payable for a single person.

He has applied for payment in respect of a child dependant and he has been requested to submit further information to allow a decision to be made.

I confirm that the department received an application for carer’s allowance from the person in question on the 27th March 2014. The medical assessment has been completed. The application is currently with a social welfare investigative officer who will establish the level of care being provided, carry out a means assessment and confirm that all the conditions for receipt of carer’s allowance are satisfied. Once the investigative officer has completed and submitted the report a deciding officer will make a decision on entitlement as quickly as possible and will notify the person concerned of the outcome.

I propose to take Questions Nos. 357 and 358 together.

Following a review of the entitlement, under the supplementary welfare allowance scheme, rent supplement has been refused to the person concerned on the grounds that she failed to supply documentation as requested, she has not re-negotiated her rent in line with the Department’s new rent limits and has not provided proof that she has been in contact with her Local Authority regarding her housing needs.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 30th April 2014. It is a statutory requirement of the appeals process that the relevant papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought from the Department of Social Protection. These papers were received in the Social Welfare Appeals Office on 12th May 2014 and the case will be referred to an Appeals Officer who will make a summary decision on the appeal based on documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.

The Department of Social Protection (DSP) is currently finalising a Request for Tender for the provision of a new Public Employment Service portal to replace the current system offered via the Department’s JobsIreland service. The new portal will provide an enhanced online Employment service for Jobseekers, Employers and DSP Staff via a responsive website. This will provide a vacancy advertising and search facility, including automated Jobseeker and Vacancy match functionality in addition to enhanced DSP monitoring of jobseeker activity.

It is intended to issue an open Request for Tender on eTenders in the coming weeks. Subject to the selection of a vendor and execution of contracts, it is hoped that the new system will be implemented by December 2014.

Pending the completion of this procurement process, it is not possible to state the costs for the new service.

One-Parent Family Payments

Jobseeker's Allowance Payments

The person concerned was awarded Jobseekers Allowance of €100.00 from 27th January 2014, which is the maximum for a customer between the ages of 18-24 years. He received his first payment on 5th March 2014.

The person concerned is repaying a previous overpayment and a deduction of €15.00 per week is currently being made from his weekly payment. Once this overpayment is repaid in full, he will revert to a payment of €100.00. There are no outstanding arrears due to the person concerned.
